1 - Eligibility: To be eligible for an E-3 visa, you must meet the following criteria:

  • You must be an Australian citizen.
  • You must have a legitimate offer of employment in the United States.
  • The position you are offered must qualify as a "specialty occupation." This typically means that the job requires a specific set of skills or qualifications, often at a bachelor's degree level or higher.

2 - Spouses and Dependents: E-3 visa holders can bring their spouses and children under the age of 21 to the United States as dependents. Spouses of E-3 visa holders can also apply for work authorization, allowing them to work in the U.S.

3 - Duration: The E-3 visa is initially granted for a period of up to two years, and it can be renewed indefinitely in two-year increments, as long as you maintain your employment and eligibility.

4 - Dual Intent: Unlike some other nonimmigrant visas, the E-3 visa allows for "dual intent," which means that you can apply for a Green Card (permanent residency) while on an E-3 visa without jeopardizing your nonimmigrant status.
